A sess\u00e3o est\u00e1 prevista para come\u00e7ar \u00e0s 14h.<\/p>\n<p>O julgamento foi suspenso no dia 1\u00b0 de outubro do ano passado, quando foram ouvidas as sustenta\u00e7\u00f5es das partes envolvidas no julgamento. Na sess\u00e3o de hoje, ser\u00e3o proferidos os primeiros votos sobre a quest\u00e3o.<\/p>\n<p>Ser\u00e3o julgadas duas a\u00e7\u00f5es relatadas pelos ministros Edson Fachin e Alexandre de Moraes que chegaram ao Supremo a partir de recursos protocolados pelas plataformas Rappi e Uber. As empresas contestam decis\u00f5es da Justi\u00e7a do Trabalho que reconheceram o v\u00ednculo empregat\u00edcio com os motoristas e entregadores.<\/p>\n<p>Durante a tramita\u00e7\u00e3o do processo, a Rappi alegou que as decis\u00f5es trabalhistas que reconheceram o v\u00ednculo de emprego com a empresa desrespeitaram decis\u00f5es da pr\u00f3pria Corte que entendem n\u00e3o haver rela\u00e7\u00e3o de emprego formal com os entregadores.<\/p>\n<p>A Uber sustentou que \u00e9 uma empresa de tecnologia, e n\u00e3o do ramo de transportes, e que o reconhecimento de v\u00ednculo trabalhista altera a finalidade do neg\u00f3cio da plataforma, violando o princ\u00edpio constitucional da livre iniciativa de atividade econ\u00f4mica.<\/p>\n<p>Antes do in\u00edcio do julgamento, a Procuradoria-Geral da Rep\u00fablica (PGR) enviou Supremo parecer contr\u00e1rio ao reconhecimento de v\u00ednculo trabalhista entre motoristas de aplicativos e as plataformas digitais.
